Advocacy is a key component of the Trucking Association of New York's (TANY) strategic plan. In addition to 91Ö±²¥ÊÓÆµPresident Kendra Hems serving as a registered lobbyist for the association, 91Ö±²¥ÊÓÆµalso retains Catalyst Government Relations and CMW Strategies to maintain a constant presence at both the New York State Capitol and New York City Hall.
TANY’s current legislative priorities include:
°Õ³ó±ðÌýAdvanced Clean Trucks (ACT) Rule, adopted by New York State in December 2021, requires manufacturers of medium- and heavy-duty (MHD) vehicles to sell an increasing percentage of zero-emission (ZE) trucks starting in the 2025 model year. The rule aims to address climate change, improve air quality, and transition the transportation sector away from fossil fuels. This is a one-size-fits-all approach that is currently unattainable while halting significant progress. Therefore the rule needs a delay. A more balanced approach is needed to allow multiple pathways towards continued emissions reduction.
In 2023 the NYC Department of Transportation began utilizing an automated weigh-in-motion (WIM) system to enforce a restriction of overweight trucks on a half-mile portion of the Brooklyn Queens Expressway (BQE). The BQE, particularly the triple cantilever section in Brooklyn Heights, has past its useful life and is in a serious state of deterioration. For safety purposes, strict weight limits were set that were applicable to all overweight trucks, whether they were legally operating under an overweight permit or not.
While automated WIM technology has been a useful tool in maintaining the BQE, there are serious concerns that must be addressed before the program is expanded.
At both the state and city levels, 91Ö±²¥ÊÓÆµhas been successful in preventing legislation which would require commercial vehicles to be outfitted with side guards, this remains a top priority of the association.

A long time priority for 91Ö±²¥ÊÓÆµhas been repeal of New York’s onerous Highway Use Tax. New York is only one of four states in the country which continues to impose this truck only tax.Â

The Indirect Source Rule (ISR) is a regulatory proposal that would fine owners or operators of warehouses and logistics centers based on how many trucks come to the facility daily. Warehouses will receive credits for each electric vehicle (EV) that utilizes the warehouse and fine for those vehicles which are not EV. Many in the industry compare this regulation to a zero-emission vehicle (ZEV) mandate – as the goal of ISR is a reduction in emissions in areas where warehouses are located. However, there are still significant questions left unanswered in terms of how this regulation will be implemented. Without clear direction, the trucking industry is in jeopardy of negative impacts on prices, routes and services.
As New York’s highways continue to deteriorate, 91Ö±²¥ÊÓÆµhas made increased infrastructure funding a top priority.
As New York moves toward legalization of marijuana, 91Ö±²¥ÊÓÆµis working to ensure highway safety impacts are considered and employer protections are in place.

91Ö±²¥ÊÓÆµcontinues to work toward addressing the driver shortage by advocating for legislation to allow drivers between 18 – 20 years of age to obtain a Class A CDL for intrastate operation following the completion of an extensive training program.

TANY’s legislative affairs efforts have resulted in key victories for the trucking industry in New York, including:
Successful in passing legislation to prohibit indemnification clauses from being included in shipping contracts, which would hold the carrier liable for all incidents regardless of fault.
Successful in passing legislation providing for a weight allowance of up to 400 pounds for vehicles fitted with an auxiliary power unit (APU).
Successful in passing legislation – The NYS Commercial Good Transportation Industry Fair Play Act – that protected the independent contractor model in New York State
Defeated proposed regulations to implement a series of truck route restrictions across the state.
91Ö±²¥ÊÓÆµsuccessfully fought to repeal the Gross Receipts Tax in New York, reduce the Petroleum Business Tax and provide a sales tax exemption on tractor trailer sales and parts.
Prevented a 45% truck only toll increase from being implemented on the NYS Thruway
Over the years, 91Ö±²¥ÊÓÆµhas successfully advocated for multiple reductions in the Ton-Mile Tax (TMT) rates and was instrumental in eliminating Thruway miles from the TMT calculation. Full repeal of the TMT/HUT remains a top priority of ours.
